☆ 現代中国社会の抱える問題−盗作 ―――――――― 2005/04/27
今回は著作権・知的所有権侵害、盗作問題について触れてみたいと思います。
昨年９月に参加した語学の教授法についてのオンライン会議でも、香港の教授
を中心にディスカッションが盛り上がりました。ーー盗作やカンニングは容認
されることが多いようです。
生徒に罪の意識が薄いのが現実。大人も堂々とやっています。
インターネットでは、あらゆる情報の入手が可能なため、それらを寄せ集めて
自分で編集し、あたかも自分自身の作品のように見せかけて提出するというこ
とが公然と行われています。
私は、中国生活一年目の重慶の大学でも、カンニングの処理に苦労しました。
親しくなった生徒たち、心を通わせることができた！と思っていたにもかかわ
らず、カンニング！信頼感が崩れてゆくのを感じました。と同時に中国に蔓延
しているカンニングについて、改めて考えてさせられたのです。
南通に来てからも、一年目に同様のことが起こりました。今でも鮮明に覚えて
います。その時は二度目のチャンスを与え、私の部屋に呼んで、テストを改め
て受けさせることで何とか無事にクリア。
―― 以下に、昨年の文化クラスの期末試験での出来事を引用します。
私一人で、１３０人の試験を実施した。
ひとりの女生徒が、堂々と、用意したノートを見ながら答案を作成しているの
を発見！？すかさずとりあげ、出て行くように言った。彼女は「もう二度とし
ないから続けて受けさせてくれ、ごめんなさい」と懇願する。
しかし、私は“Go out! You failed”とつっぱねた。ノートと答案をとりあげ
て出て行くように再三言っても、泣き縋って離れない。ーーこれでは他の生徒
の妨害になる。ーー私の後を追い回し、幼児がダダをこねるように「お願い、
お願い、もう二度としませんから、私にチャンスを下さい」と離れない。
カッときた私は、語気を強め“GO OUT！”と言い捨てた。彼女は泣き止み、席
に戻って突っ伏したまま部屋を出ようとはしなかった。ーー他の生徒は、その
せいでシーンとなり、黙々と答案を書き続ける姿を見て「厳しい処置を見て、
何か感じたかな」と思った。
試験も終わりに近づき、最後の一人が頑張っていたとき、彼女が通りすがりの
中国人の担任教師を見つけ何かを訴えているのを見た。その教師、早速教室に
入ってきて私に抗議。私は「まだ試験中だから邪魔するな。教室の外で待て」
とひと言。
試験が終わり、その担任教師と話をした。「彼女はカンニングなんかしていな
いと言うが、実際何が起こったのか」と聞く。――私は事情を説明した。
すると、「それなら絶対許せないことだ。処罰は当然だ」と同意する。しかし
「彼女にチャンスをもう一度与えてやってほしい」と付け加えた。私は言われ
るまでもなく、来週、私の部屋に一人できて、一から試験を受け直すように言
うつもりだったからそれに同意した。ーー「カンニングという行為を罰するの
であって、生徒本人を憎んでいるのではない」と強調しながら。
今回は、テストではなく、
映画の「東京物語」の感想文を書かせる課題を出しました。４クラス中、明ら
かに盗作―――インターネット上の情報の切り貼り、或いは中国語から英語へ
翻訳しただけという作品が各クラス２〜３名ありました。Ｅメールで送ってき
た生徒へは、それが盗作＝罪）なのだということを伝え、反省した１人は自分
の作品を再度送ってくれました。
はじめの言い訳は、〜〜中国語から英語に翻訳するだけでも相当な時間を費や
した〜〜ということでしたが、その努力には評価を与え、それでも自分の意見
ではないから点は与えられないとハッキリ言いました。ーーその生徒は、その
後何度もメールをくれ、最後にはとても私のことを理解してくれるようになり
ました。
明らかに盗作だと思われる生徒には、零点しかつけません。そして、授業では
個人の名前は公表せず反省を促しました。
・ＩＰＲ＝(Intellectual Property Rights)−知的所有権を知っていますか？
・Plagiarism−盗作）という単語は知っていますか？
みんなはシーンとして聞き入っていました。
「私がみんなに求めているのは自分自身の感想・意見です。文法が間違ってい
ても、語彙が貧困でもかまいません。正直な気持ちを知りたいだけなのです。
インターネットには、映画の感想が世界各国から寄せられていて、それを読ん
で納得したり、自分の意見と照らし合わせるのは結構です。
でも、それを切り貼りして編集し、自分の作品として提出することは、知的所
有権の侵害に当たります。盗作です。物品ではなくとも、考えを盗むことも罪
なのですよ。名前は言いませんが、思い当たる人は、私にＥメールを送って下
さい」
中国は面子を重んじる国です。個人的に糾弾して恥をかかせることは絶対にし
てはならないこと。でも事の重大性を感じるようにみんなに伝えなければなり
ません。教師と生徒の間の信頼感―――教える仕事に２５年以上携わってきて
習得した哲学です。これがなければ、授業内容や教え方をどれだけ工夫しても
達成感は得られません。
カンニングに関して、その原因を考えてみました。
「孝心」を刷り込まれて育った子供たちは、少しでも両親に楽をさせようと努
力しています。勉強、親、教師からのプレシャーが大き過ぎます。そのための
自殺も多い。
教育重視は、アジアの各国では当然の現象ですが、ここ中国では、将来の仕事
と収入、そして豊かな生活、という思考パターンが浸透しているため、学生は
成績を上げるためには手段を問わずという傾向になりがちです。――カンニン
グを阻止するのが難しいわけです。
最近では、携帯電話を使ってのハイテク・カンニングや、代理者にお金を払っ
ての替え玉受験など、手段が狡猾になってきています。さらに教える側におい
ても、教授がネット上で情報を集め、あたかも自分の作品のようにして発表し
ていた話・・・。
これらを排除するために、受験前に全員に宣誓書を書かせるとか、違法行為を
した者は卒業資格を与えないなどの、厳しい罰則を設けるという大学もあるよ
うです。
―― カンニングと密接に関連するのが、ビジネス社会での盗作問題。
ＤＶＤやビデオ・本などの著作権侵害です。特に南部地域がその元凶らしく、
海賊版天国といわれるゆえんです。私の住む南通で売られているＤＶＤ映画も
コピー版が大半です。１枚１０元もしないのですから、我々外国人は大喜びで
何十枚も買いますが、中身は、..字幕の訳が合わなかったり..途中で何度も停
まったりという欠陥商品が多く含まれているのも事実。
中国製品はやはり、国際的に、安かろう悪かろうというイメージであることは
否めません。安く作って大量に売る、かつての日本と同じことを現在の中国が
やっています。

―― Emerging Social Problems-plagiarism ――
During the Online discussion on Language teaching and
learning held last September, a professor from HK raised
the issue of
‘plagiarism’. Yes, this should not be forgotten, as
China is a
‘copy paradise’ where many DVDs, CD-Rs, music tapes and
books are copied without authors
’ permissions. That means there is no guilt feeling of
‘violation of copy right’. Let alone, students do copy
many chunks of comments from the Web pages and paste, edit
on their paper and submit as if they were their own
products. This is taken for granted unfortunately. They do
not realize the seriousness of their conduct- stealing the
intellectual property- a kind of crime.
My first year in China started at a college in Chongqing.
There I had the similar incidence of cheating. Although I
made friends with some students on a personal level, they
cheated me in the exam. Our trust collapsed. At the same
time I was reminded of the seriousness of this situation
in this country.My second year in Nantong, I encountered
another case of cheating in the final exam. There was one
girl who copied from her prepared documents during the
exam. I asked her to go out of the classroom and come to
my room for a retrial. I gave her a second chance.
The following is the quote from the last year’s cheating.
― I administered the final exam for 130 students alone.
I found one girl copying from her prepared paper and told
her to go out immediately. She continued saying that she
would never do that again and asked for mercy. However, I
insisted on her leaving the room. I took her notes and
exam paper and ordered her to leave. She did not seem to
get my message and walked after me crying. She repeatedly
said,
‘Please, please I will never do it again. Please give me
a chance.
’ I got upset and told her to go out. She finally stopped
crying but remained in her seat with her head down until
everyone else finished the exam. Other students turned
very silent. They must have felt the gravity of cheating
upon seeing the punishment. Toward the end of the exam,
this girl found her homeroom teacher and asked her
something. That teacher came into the classroom and asked
me about the happening. As there were a few students still
writing the paper, I asked her to stay outside. After the
exam, she told me that the girl did not cheat and asked me
what actually happened. I explained the incident and the
teacher seemed to be understanding. She said,
“If that is the case, she should be severely punished,
”but added that I should give her a second chance. I
agreed and asked the girl to come to my room for a retrial
exam. I also said to the teacher that I did not hate the
girl but hated the crime itself.
This time, I gave students a homework assignment to write
their impressions upon seeing the film
‘Tokyo Story’. There were a few students who copied or
translated movie reviews from the Internet. When they
emailed me, I replied that I could not give them any marks
as these were someone else
’s opinions. One of them did the soul-searching and she
sent lots of messages afterwards. Apparently, we were able
to establish a strong emotional tie. She seems to
understand the seriousness of plagiarism and trust me.
Chinese children have been taught the importance of’
‘Filial Piety
’. They feel compelled to live up to the parents’
expectations. Pressures from parents, teachers and studies
are so big that some students commit suicide. Asian
countries, in general, are enthusiastic about children
’s education. In China, well-educated people are believed
to secure a good job, hansome amount of income and rich
life. Students, therefore, tend to be preoccupied with
getting good marks in whatever ways possible. I can say
this is why cheating is unavoidable and uncontrollable.
Nowadays, there are unusual use of mobile phones for
cheating (high-tech cheating) and surrogate cheating
(paying a huge amount of money to a good student to take
exams). Moreover, professors allegedly showed their
publications made out of a hotchpotch of information on
the Internet. To eliminate these illegal doings, some
universities require all applicants to write an oath of
honesty and disqualify those who have illegally passed
exams.
Closely related is the problem of plagiarism and the copy
right violation. DVDs, videos and books are the main items
concerned. In south part of China is often called
‘pirates version paradise’. DVDs sold in Nantong are
mostly pirated versions. People including foreigners can
buy dozens of them, because each costs less than 10 yuan.
However, some have defaults in them such as bizarre
translated subtitles or corrupt parts. Chinese products
are after all substandard, aren
’t they? China is selling cheaper goods in quantity at
lower prices. This business practice is the one Japan once
did in the past.
