☆ お役所仕事 ―――――――――――――――――― 2005/02/09
「外国専家」というのが我々外人教師に与えられた呼称です。なんと光栄なこ
とか！でも、外国で働くことでの煩わしさはたくさんあります。パスポートと
ビザ、これがまず問題。中国の場合、それに専家証と居留証が加わります。
その居留証に変更があったのです。昨年１２月から、ビザと居留許可がセット
になって、パスポートに貼り付けられることに。今迄の緑色の居留証は廃止で
す。その変更の過程も説明も何もないまま、自分で勝手に判断していました。
日本帰国後、インターネットで情報収集をしてやっと事情が飲み込めました。
―― ビザに関して：
観光ビザは２００３年９月に不要になったことはかなり知れ渡っているのです
が、私のように中国で働く場合は、就労ビザが必要です。大学との間で契約を
取り交わした後で、交付の手続きをしてくれる。今までは、帰国の度に三ヶ月
有効のビザを買っていました。年に何回も行き来する人は、多次ビザのほうが
割安。
今回の改正では年に何回帰っても４００元、マルチビザと同じ扱いなのです。

│＊日本人が中国に滞在するためのビザ(査証)及び「居留許可(旧：居留証)」
│は中国政府の所管事務です。以下の案内は、当館が上海市公安局出入境管理
│局(以下「出入境局」)に２００４年１２月２８日に問い合わせた結果であり
│その後変更の可能性もありますので、実際に手続きを行われる際は、本文末
│尾の問合せ先にお尋ね下さい。

│《外国人簽証和居留許可工作規范》及び《外国人口岸簽証工作規范》が
│２００４年初めに制定されたことをうけて、外国人のビザ及び居留証につい
│ての規定が大きく変わり、中国各都市で順次実施されています。

│主な変更事項(日本人に特に関係するもの)
│
│１．従来の「外国人居留証(以下「居留証」)」は、「居留許可」としてパス
│ ポートに直接貼り付ける形式になります。
│
│２．ビザの期間延長・変更等の申請をする場合、元のビザの種類に係わらず
│ 延長・変更時の提出書類に拠り改めて審査が行われ、相応のビザ、又は
│ 「居留許可」が発給されることになります。
│
│３．新しい「居留許可」は主に以下の８種類となります。
│ （１）任職（副総経理以上の就業目的滞在）
│ （２）任職居留許可所持者の家族
│ （３）就業（任職以外の就業目的滞在）
│ （４）就業居留許可所持者の家族
│ （５）記者（報道関係者の滞在）
│ （６）記者居留許可所持者の家族
│ （７）学習（就学目的滞在）
│ （８）公務パスポート所持者対象の居留許可

―― 今回の私の問題。
居留許可と就労ビザ(今年８月３１日まで有効)のついたパスポート、有効期限
が今年の１１月１３日です。７月に日本に帰国し、また８月末に中国に再入国
する際にも使用できます。ところが、８月３１日以降、ビザ兼居留許可が期限
切れになり、更新後、新しいパスポートに貼り付けてもらわなければなりませ
ん。
新しいパスポートの更新はぜひ日本で！と思い、近所の旅券センターに申請を
しに行きました。でも何か不安。
前のパスポートも返却してもらえるのか、二冊同時に所持してもいいのか問い
合わせました。そして結論。旧のパスポートは最初の数ページにVOIDのパンチ
を入れて返却するということ。ビザと居留許可のシールの張ってあるところは
無傷らしいのですが、、、そして二冊同時に有効の旅券を所持することはでき
ない、違法だということでした。
旅券センターにわけを話して、申請を取り下げました。何とか間に合いました
が、その理由を文書にして提出するよう求められ、翌日あわててもって行きま
した。▽▽

│今回、パスポート申請の取り下げをお願い致します。今回パスポートの有効
│期限が２００５年１１月１３日まであるにもかかわらず、１月の時点で切り
│替えの手続きをしてしまいました。

│中国の就労ビザを持っており、今回の渡航にはマルチビザを取得しました。
│これは居留証を兼ねたものです。今回２月末に中国に戻るためにこのビザが
│必要ですので、新しいパスポートに変更するのは早過ぎたようです。
│
│次回、２００５年７月に日本へ帰国する際に、改めて１０年のパスポートを
│申請いたします。

―― そして、新たな疑問が出てきた。
VOIDのパンチを入れられても、ビザの部分が無傷なら有効にならないのか？
旅券事務所で相談したら、ここはパスポートセンターで、各国のビザの事情に
ついてはわからないとのこと。中国の総領事館に問い合わせるように言われま
した。
翌日電話。ずっと話し中。埒が明かないので直接出かけることにしました。
インターネットの地図で場所を確認。そういえば、最初中国に出かけるとき、
就業ビザの申請に来たことがあったっけ！あの時は、重慶の大学からの招待状
と、日本の病院でやった健康診断書を持参したような、、、以後ずっと中国で
切れ目なく働いてきたので、ビザや居留証の申請はずっと大学の人に代行して
もらっていました。
―― この日、受付の若い女性にまず聞いてみた。
パスポートに添付してある就業ビザと居留許可のページを見せて説明。そして
肝心な質問！パンチを入れられると有効期限内のビザが張ってあっても無効に
なるのかどうか。彼女は冷たく一言、「そうです、無効です」
よく見ると、ビザとは書いていない。パスポート番号と中華人民共和国外国人
居留許可の番号が記載してある。そのシールを新しいパスポートに張り替えて
もらうこともできない。パスポートの番号もすべて変わってしまうからです。
「じゃ、今回そして７月に帰国したときにも、日本国内でパスポートの切り替
えをすることは出来ないのですか？」すると、
「ここは中国総領事館です。日本の方のパスポートは日本政府が発行するもの
ですから、外務省に問い合わせてください。」
「え〜、外務省ですか？？？」
私はさらにしつこく質問。
「観光ビザは不要になりましたよね。じゃ、ビザなしで日本を離れ中国で就労
ビザに切り替えてもらうことは可能ですか？」受付嬢はうんざりした口調で、
「ビザの申請は日本国内の領事館で出来ますが、居留許可は中国でやってくだ
さい。日本ではできませんから」
居留許可とビザは(中国の)公安局で出来るのは知っています。大学から自転車
で１０分の近距離にありますから、これは簡単。でも、来年度の契約を交わし
た後でないとできません。じゃ、パスポートを更新するのは、契約更新前、中
国で？ ビザと居留許可は、パスポートが新しくなってからの話。
―― 大学の世話役に聞いてみた。
誰も詳しい手続きを知らない。知らない！といって責任逃れするのではなく、
じゃ〜分かるまで調べてみよう！と思わないのだろうか。さんざんＥメールで
聞いて、問題点解決方法を尋ねたが無駄だと分かった。そこでまた以前のクセ
「自己来！」自分でやるよ、仕方ない。インターネットで探しました。

この上海の日本領事館ホームページで、漸くわかってきたことは、、、。
費用は日本とほぼ同じ。必要書類は日本より多い。そして時間がかかることが
判明。南通在住の私にとって、上海の日本領事館に行くのは大仕事だ。往復に
かかる時間、申請書を取りに行って、その場で書いて提出、一週間後にまた取
りに行かねばならない。
上海の日本領事館は窓口がひとつだけ、混雑と待ち時間の緩和のため、受け取
り時間を４時から５時の１時間、申請時間を９時から１１時半、１時半から３
時半に限定している。
申請時に必要なものは、写真２枚、戸籍抄本、費用は１０年が１１５３元、５
年が７６９元、申請から受け取りまで、一週間必要。
日本の場合、費用は１０年が１５０００円、５年が１００００円。書類は写真
１枚のみ。近くの旅券センターまで電車と徒歩で４０分ほどで行ける。
ーーなんと簡単なことか！
―― さらに耳寄りな情報。

│ 滞在可能）当地でビザを申請することはできますか？
│Ａ４：できます。但し、取得できるかどうかはあくまで中国側の出入境局の
│ 審査結果によります。

│Ｑ５：ビザなしで当地に来た後、当地で「就業」「学習」等の「居留許可」
│ を取得することはできますか？
│Ａ５：ビザなしで当地に来た場合、まずは当地にてＬ(旅行)ビザ等のビザを
│ 取得し、その後「就業」又は「学習」の「居留許可」を申請すること
│ ができます。

ということは、、、、？・・・私は一人で悶々と考えました。
次回８月末に中国に戻るときは、ビザなし。日本で新しいパスポートを作って
おく。入国審査では、観光目的だと言えばいい。大学に着いてから、居留許可
とビザ申請をしてもらう。ーーこの案、どうでしょうか？

「Red Tape」
“Foreign Expert” What an honorable title I have been
given! However, working in a foreign country is not easy.
It involves a lot of formal procedures. To begin with, I
have to deal with a passport and visa. In China,
foreigners need to obtain
‘residence permit’ and ‘foreign experts certificate’.
Since last December,
‘residence permit certificate’ has been abolished and
combined with a visa attached to a passport. There was no
explanation for this change and I did not take notice of
it seriously. After returning to Japan, I searched for the
accurate information on the Net.
It is widely acknowledged that Japanese tourists require
no visas if their stay is within 15 days. ( September,
2003) However, I need a work visa to work in China. This
is issued after signing a contract with an employer.
Previously, I have purchased a single reentry visa (valid
for 3 months) each time I go back to Japan. Those who go
back and forth frequently would rather obtain multi visa.
This time, all foreign experts were asked to pay 400 yuan-
combination of multi visa and residence permit.
My problem: I cannot renew my passport now in Japan,
because my visa and residence permit will automatically be
void when my passport is renewed. My passport is valid
till November 13, 2005. My visa/residence permit is valid
till August 31, 2005. After applying for the passport
renewal at the passport center in my neighborhood, I felt
a bit uneasy about the previous passport with
visa/residence permit attached. I called the passport
center to assure the return of my old passport. A person
in charge said that it might be invalid after obtaining a
new passport. It is illegal to possess two passports at
the same time. I cancelled my application immediately. But
this was such an unusual case that I had to write a reason
for the cancellation. The following is the letter of
formal apology.

To a person in charge of Passport Application,
I would like to cancel my passport renewal application.
My passport is valid until November 13, 2005, however, I
made the renewal application in January, which was a
little too early. As I have a multi visa cum residence
permit attached to my passport, I need to show it to
reenter China. I am going to renew passport in July when I
return to Japan again.
I am sorry for causing trouble to Mr.XXX at XXX Passport
Center Local Office and those working at Kyoto Passport
Center. Today, I received my passport which was submitted
yesterday.

There is another question. If my old passport gets punched
indicating VOID, is
the VISA page invalid as well? At the passport center, I
was told that nobody knew about the visa requirements in
each country and that I should call Chinese consulate in
Osaka. So I did, but the line was busy all the time. I
decided to go over the following morning.
At the Chinese consulate, I remembered my first visit to
this place when I was admitted to work in Chongqing.
Bringing a health certificate, the invitation letter from
the university, lots of waiting and endless formal
procedure.. While working in China for more than two
years, I have entrusted everything to a college secretary.
Upon entry, I talked to a receptionist who appeared to be
Chinese. I explained my problems to her showing my
passport and work visa cum residence permit. And I asked
the most important question,
“ If the passport is punched as VOID, will my visa be
invalid as well?
” She replied bluntly, “Yes, it will become invalid.” I
had a closer look at the visa. It did not say VISA.
Instead, it indicated my passport number and the number of
PR China foreign residence permit. This is a plastic sheet
attached to the passport, which seems impossible to paste
to a renewed passport. Because when a passport is renewed,
it will bear a new number. Then, does that mean I cannot
renew my passport now and in July as well? She said in a
businesslike manner,
“This is Chinese consulate. Your passport is issued by
the Japanese government. You had better ask the Foreign
Ministry.
” ??????
I asked further. “Tourist visas are unnecessary, are
they? Then is it possible to reenter China without a visa
and obtain a work visa in China?
” She had a look at the visa which is combined with the
residence permit. She said,
“We can issue a visa, but a residence permit is issued by
the Public Security Department in China. You should get
one in China.
” I know, I know… Nantong Public Security Department is
located within 10 min-bicycle ride from my place. It is
relatively easy, but I cannot do anything unless I renew
my work contract. Then when and where can I renew my
passport?
Conclusion: Get a new passport in China and sign a work
contract. Then I will be given a visa and residence
permit.
I Emailed one of the college secretaries inquiring about
the quickest and simplest procedure. She herself did not
know much and asked her colleagues. Still, she continued
saying that nobody knew for sure in detail. Eventually she
told me to ask someone else who has much experience on
visas and passports. Again, I was disappointed at the
Chinese custom of evading responsibility. How come they
look into the matter themselves more seriously? I ended up
checking myself.
“Do it myself! There is no choice.” The following is the
information provided on the Net by the Japanese consulate
in Shanghai.

Passport application fee is the same as that of Japan,
however, they require more documents and time. As I live
in Nantong, going to Shanghai twice is time & money
consuming. There is only one reception that deals with the
passport application and receipt. To ease the congestion,
they restrict the time for receiving passports between
4:00 and 5:00. Application time is 9:00-11:30 and
1:30-3:30. They require two photos and a family
registration certificate.
Meanwhile, the Japanese passport center is about 40-min
journey from my home. I need to submit only one photo.

Q4: If I come to China without a visa, can I apply for a
visa in China? A: Yes, you can. However, you should be
admitted by the immigration officer at Chinese airports.
Q5: After entering China without a visa, is it possible to
obtain
“Work Visa” or “Student Visa”? A: You can obtain L
visa (Tourist Visa) first, and then apply for
“Work Visa” or “Student Visa”.

What does it mean? I thought and thought. When I come back
to China in August, I will have no visa, but I will have a
new passport issued in Japan. At the immigration, I should
say
“visiting someone or sightseeing.” After arriving at my
university, I can ask for the tourist visa and switch to
work visa. What do you think of this idea?
